BILLET: Senior Appellate Government Counsel

INFORMATION: The Senior Appellate Government Counsel will represent the United States before the Navy-Marine Corps Court of Criminal Appeals, the U.S. Court of Appeals for the Armed Forces, and the U.S. Supreme Court in court-martial appeals and petitions for extraordinary relief. Counsel will research and prepare briefs, appellate motions, and other litigation documents addressing issues on appeal during review of courts-martial. Counsel will also advise on and litigate appeals by the United States of trial court rulings. In addition to those duties, the Supervisory Appellate Counsel will lead and mentor junior counsel; manage the brief writing process for cases assigned to counsel; research and edit briefs and ensure timely submission; coordinate reserve support matters within Code 46; and advise the Code 46 Director on reserve matters and appellate law. As appellate subject matter expert, counsel will advise trial counsel and staff judge advocates throughout the Navy and Marine Corps on military justice matters.

INFORMATION: The Reserve VLC Section Head’s primary duties are to provide leadership and administrative management for the training and work product of the Reserve VLC, and support the Chief VLC of the Marine Corps execute the mission of the VLCO. VLC attorneys are tasked to augment and support active-duty VLC by preparing written pleadings for use at trial and in appellate pleadings before the Navy-Marine Corps Court of Criminal Appeals (NMCCA) and the United States Court of Appeals for the Armed Forces (CAAF), drafting writs seeking enforcement of victim rights at NMCCA, drafting amicus curiae briefs for filing at the NMCCA and CAAF, providing legal research & writing support to VLCs, providing written analysis and proposals on law and policy for VLCO Headquarters, and providing state-specific VLC training pursuant to Section 550C of the FY2020 NDAA. The support and training provided shall enhance VLCO ability to provide legal advice, counseling and representation to victims of sexual assault, domestic violence, and other crimes and to protect victims’ rights at all stages of the military justice process. The Reserve VLC’s duties are to be carried out primarily within the assigned region and pursuant to law, regulation, and policies issued by the OIC, VLCO. Specific duties include the following: Legal research and drafting of pleadings, motions, writs, briefs, and appeals; creating and attending VLCO training events; reviewing proposed and new legislation, and reviewing and proposing VLCO policy.

INFORMATION: Serves as a Reserve attorney-advisor in the Judge Advocate Division's Military Justice Branch (JMJ) directly supporting Navy Criminal Law Division (Code 20). This Branch provides military justice advice, including on Service-wide policy and procedures, to promote justice and good order and discipline in the Marine Corps. Duties include providing military justice related support, to include information collection, access, and reporting requirements; reviewing and drafting legislation and authorities; and providing guidance and training to practitioners and command officials. The billet holder will belong to the Reserve Military Justice Branch (JMJ) of the Reserve Legal Services IMA Detachment. Applicants should be willing to regularly work in JMJ's Pentagon based offices, and duties may include attending recurring meetings as a representative for JMJ. Recent military justice experience is preferred.

INFORMATION: Serves as a Preliminary Hearing Officer ("PHO"), PHO Detachment, Military Justice Litigation Support - Reserve Section, Judge Advocate Division (IMA). The billet holder's responsibilities will generally include coordination with government and defense counsel in scheduling Article 32, UCMJ preliminary hearings, making pre-hearing findings regarding the production of evidence and witnesses pursuant to RCM 405, serving as a PHO at Article 32 hearings (in-person or via VTC), and writing reports containing the determinations required by RCM 405(a) including, but not limited to, probable cause and disposition recommendations for the convening authority's consideration. Prior experience as a PHO or in military justice is preferred, but is not required.
